Family Account Terms and Conditions
These Terms and Conditions (“Terms”) govern the use of the Family Account feature provided by Wint Wealth and form a legally binding agreement between the users of the feature and Wint Wealth. By using the Family Account functionality, all users agree to be bound by these Terms in addition to the Wint Wealth General Terms of Use.
1. Definitions
- Primary Member: A SEBI-KYC verified investor on Wint Wealth who initiates the Family Account and invites another SEBI-KYC verified investor (Secondary Member) to join. The Primary Member is authorized to view and manage the investment portfolio of the Secondary Member.
- Secondary Member: A SEBI-KYC verified investor who consents to being added to the Family Account by the Primary Member and grants access only to the Primary Member to view and manage their investment portfolio and related information.
2. Feature Scope
- The Primary Member shall have the ability to:
- Add a Secondary Member by initiating a two-factor (2FA) authenticated consent flow in accordance with applicable regulations.
- View the investment portfolio of the Secondary Member.
- Buy and Sell transactions can be placed by the Primary Member on behalf of the Secondary Member. The transaction can only be approved by the Secondary Member through their desired payment method. Secondary Members will have an option to cancel the transaction.
- Remove a Secondary Member from the Family Account at any time.
- Access the KYC photograph (selfie) submitted by the Secondary Member during the SEBI-mandated KYC process, solely for verification and account linkage purposes.
- Access other profile information on the platform.
- Take actions related to the product, stated as below:
- Initiate DDPI activation. Final activation will happen only once the Secondary Member completes Aadhaar E-sign.
- Initiate 15G/H form filling. Final signing will happen only once the Secondary Member completes Aadhaar E-sign.
- Initiate SIP mandate on behalf of the Secondary Members. Final SIP will be activated only once Secondary Member gives the mandate for funds deduction for SIP.
- Refer other friends and family to the platform on behalf of the Secondary Member.
- The Secondary Member shall have the ability to:
- Accept or reject an invitation to join a Family Account by undergoing the 2FA consent flow. By providing this consent, the Secondary Member agrees to these Family Account terms and conditions.
- Remove themselves from a Family Account at any time.
- A user can be part of only one Family Account at a time, either as a Primary or a Secondary Member. Multiple group memberships are not permitted.
3. Consent and Authorization
- By undergoing the 2FA consent flow, to (i) join a Family Account and (ii) on every login by the Primary Member, the Secondary Member:
- Confirms that they are voluntarily providing consent to the Primary Member to access their investment portfolio and manage their profile as described hereunder.
- Authorizes Wint Wealth to provide the Primary Member with access to the information as described hereunder. .
- Understands that this consent is revocable at any time by exiting the Family Account.
The 2FA authentication shall be required from the Secondary Member for each login attempt made by the Primary Member. Further, the Primary Member shall automatically be logged out of the Secondary Member’s profile at the time of End-of-Day processing (EOD)/at a defined time as may be determined by Wint Wealth. Any subsequent login shall be permitted only after successful 2FA authentication.
4. Eligibility
- Both the Primary and Secondary Members must be SEBI-KYC verified investors registered on the Wint Wealth platform.
- Wint Wealth reserves the right to verify the identity and KYC status of both parties before enabling any Family Account functionality.
5. Data Privacy and Use of Personal Information
- All personal and financial data shared under the Family Account feature shall be processed in accordance with applicable data protection laws and Wint Wealth’s Privacy Policy.
- Access to KYC photographs and investment data is granted solely for the functionality and intent of the Family Account feature and may not be used for any unauthorized purposes.
6. Limitations and Liability
- Wint Wealth shall not be liable for any misuse of access by the Primary Member once valid consent is obtained from the Secondary Member.
- The responsibility for actions taken within the Family Account, including investments made on behalf of the Secondary Member, lies solely with the consenting users.
- In the event of a dispute between Primary and Secondary Members, Wint Wealth may, at its discretion, suspend access to the Family Account feature for both parties until the matter is resolved.
7. Modifications and Termination
- Wint Wealth reserves the right to modify or discontinue the Family Account feature or these Terms at any time. Continued use of the feature constitutes acceptance of the modified Terms.
- Wint Wealth may also revoke access to the Family Account feature if there is any violation of the platform's policies or applicable laws.
